Terms

1. General 1.1. 
These sales conditions always form an integral and irrefutable part of any agreement confirmed in writing between the customer and MXcenter Lommel, whether by letter, fax or e-mail. 

2. Quotations 
2.1. All given quotations and rates are non binding to the seller and are only given as information. They can there for never form any engagement. Not respecting the given rates can not form a cause for reimbursement by the seller. 

3. Confirmations
3.1. No reservation, order or contract is final until this contract, reservation or order is signed by the customer for agreement, is in the possession of MXcenter Lommel, and is confirmed in writing by MXcenter Lommel to the client. Any deposits and/or guarantees have to be paid too.
3.2. The person signing this contract, order or reservation guarantees by his or her signature that he or she is empowered to do so.
3.3. Modifications and additions are only valid if made in writing and signed by both parties.

4. Deposits and guarantees
MXcenter Lommel is permitted to ask the customer for a deposit and/or guarantee. If the deposits and/or guarantees requested are not paid within the time stated, the contract will automatically and without warning be deemed to have been breached at the customer’s expense.

5. Changes to the number of participants or cancellation of a booked event by the customer
5.1. Any change to the number of participants for a booked event must be notified to the hotel in writing more than 2 working days before the event commences if the change is no greater than 20% of the original number of participants, but more than 15 days before the event commences if the change is greater than 20% of the original number of participants.
5.2. In the event of a change to the number of participants being notified that is not in accordance with article 5.1., the original number of booked participants or the number actually present will be charged, depending on which number is the greater.
5.3. A complete cancellation may only be made by registered letter. The date of receipt of this letter will apply as the cancellation date and will be deemed to have been received 3 working days after the postmark on the letter.
5.4. In the event of the complete cancellation of a booked event more than 30 days before the event commences, 20% of the total amount of the event contract will be levied as a cancellation charge. 
5.5. In the event of the complete cancellation of a booked event more than 15 days before the event commences, 40% of the total amount of the event contract will be levied as a cancellation charge.
5.6. In the event of the complete cancellation of a booked event less than 15 days before the event commences, 80% of the total amount of the event contract will be levied as a cancellation charge.
5.7. In the event of a no show, no cancellation, or cancellation later then 2 working days before the event commences, 100% of the total amount of the event contract will be levied as a cancellation charge.
5.8. For reservations and orders less then € 350 VAT in., the followings tersl are applied; 5.4 – 15 days, 5.5 – 8 days, 5.6 – 8 days. 

6. Additional charges
6.1. All meals, drinks or other services that are not mentioned in the agreement will be charged to the customer by MXcenter Lommel, except where the hotel is notified in writing that these individual expenses are to be settled by the participants themselves.

7. Occupying and vacating of studio's 
Except where there are contractual stipulations to the contrary, studio's that have been reserved for customers will be available from 2.00 pm, while studio's being vacated by customers leaving must be made available by 10.30 am.

8. Liability
8.1. The customer will insure MXcenter Lommel against any claim for damages made by third parties in the event that this damage is caused by participants at the customer’s event. 
8.2. The customer is also liable for any damage caused to MXcenter Lommel or its staff by participants at the customer’s event.
8.3. The customer and the contractor are jointly liable with regard to MXcenter Lommel for any damage caused to persons, buildings, furnishing or equipment belonging to MXcenter Lommel and areas that are accessible to the public.

9. Complaints 
9.1. Complaints relating to the services provided can only be accepted if they are made in writing to MXcenter Lommel within seven days of being provided.

10. Payment 
10.1. All of our invoices are payable in full at our address, with no discount. In the event of an invoice not being paid by the date on which it is due, the amount of the invoice will, automatically and without any warning being served, be increased by a minimum charge of € 65, plus a late payment charge of 1% per month from the date of the invoice until the invoice has been paid in full.
10.2. Any bill where there is a price reduction, rebate or commission granted by the hotel keeper will revert to full price in the event of non-payment on the due date.
10.3 In case of non payment, MXcenter Lommel reserves the right to block acces to the studio.

11. Rent of apartments for 1st residence
11.1 If the tenant wishes to use the studio as his legal 1st residence, this will have to be requested at MXcenter Lommel in writing. The general Belgian rental legislation will only be applicable after written request and approval by MXcenter Lommel .

12. Jurisdiction
12.1. Any dispute regarding our invoices will come under the jurisdiction of the courts at Turnhout. Belgian law applies.
